These Terms of Service ("Terms") govern your use of the Momentum mobile application (the "App") and the checkindaily.app website (the "Site"), together the "Services," operated by Karthik Appannagari ("we," "us," or "I").

By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 16 years old to use the Services. By using the Services, you represent that you are 16 or older and that you have the legal capacity to enter into these Terms.

2. Your account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate information and to keep it up to date.
• Notify us promptly at the contact email above if you suspect unauthorized use of your account.
• You may delete your account at any time. We may suspend or terminate accounts that violate these Terms (see Section 11).

3. The Services: habits, streaks, XP, and commitments

Momentum lets you create habits, check in, build streaks, earn experience points ("XP"), level up, and optionally start "commitments" that carry XP rewards and penalties.

Virtual items have no monetary value. XP, levels, streaks, badges, commitments, "stakes," and any similar in-app elements are virtual and for motivational and entertainment purposes only. They have no cash or monetary value, cannot be exchanged for money or anything of value, and cannot be transferred or sold. Commitments and their penalties involve only virtual XP — they do not involve real money, wagering, deposits, or any financial stake of any kind. The Services are not a game of chance and do not constitute gambling.

We may adjust, reset, or recalculate XP, streaks, levels, or commitment mechanics as we improve the Services.

4. AI features and informational content

The Services may generate personalized plans, recommendations, and insights using artificial intelligence. This content is provided for informational and motivational purposes only. It may be inaccurate, incomplete, or not suitable for your circumstances, and you should use your own judgment before relying on it.

Not professional advice. Momentum is a habit-tracking tool, not a medical, mental-health, fitness, nutritional, or other professional service. Nothing in the Services — including AI-generated content and any habit suggestions relating to fitness, sleep, mental health, hydration, or nutrition — constitutes medical or professional advice. Always consult a qualified professional before making decisions about your health, and never disregard professional advice because of something you read in the Services. If you are experiencing a medical or mental-health emergency, contact your local emergency services.

5. Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms;
• Attempt to access another user's account or data without authorization;
• Reverse engineer, scrape, overload, disrupt, or interfere with the Services or their infrastructure;
• Upload content that is unlawful, harassing, hateful, infringing, or harmful;
• Misuse social features (for example, harassment, spam, or sending unwanted friend requests);
• Circumvent or manipulate XP, streak, or commitment mechanics through automated means or exploits.

We may remove content or restrict accounts that we reasonably believe violate these rules.

6. Social features and user content

The Services include social features such as friend requests and the ability to mark habits as public. You are responsible for the content you create and for what you choose to share. By marking a habit public or sending a friend request, you understand that certain information (such as your display name and shared habit progress) becomes visible to other users as described in our Privacy Policy.

You retain ownership of the content you create. By submitting content to the Services, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, display, and process that content solely for the purpose of operating and improving the Services.

7. Subscriptions and purchases

The Services may offer a paid "Pro" tier or other in-app purchases. If you purchase a subscription or other paid feature:

• Payment is processed by Apple through the App Store, subject to Apple's terms. We do not collect or store your payment-card details.
• Subscriptions may automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple account settings.
• Except where required by law or by Apple's policies, payments are non-refundable. Refund requests are handled by Apple.

We may change pricing and the features included in any paid tier; changes will not affect a subscription period you have already paid for.

8. Intellectual property

The Services, including the Momentum name, logo, design, software, and original content (excluding your user content), are owned by Karthik Appannagari and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works from the Services except as expressly permitted.

9. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any content (including AI-generated content) will be accurate or reliable. You use the Services at your own risk.

10. Limitation of liability

To the fullest extent permitted by law, in no event will Karthik Appannagari be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Services, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us, if any, in the twelve months before the claim, or (b) twenty U.S. dollars (US$20).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services. Upon termination, your right to use the Services ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

12. Indemnification

You agree to indemnify and hold harmless Karthik Appannagari from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey, except where applicable law gives you the right to bring a claim elsewhere.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you within the Services. Your continued use of the Services after an update constitutes acceptance of the revised Terms.
